1. Eligibility: The Ninja Graphics Baggo Bag Toss Game Giveaway (“Contest”) is open and offered only to legal N.Y. resident who, at the time of entry are ages 18 or older and reside in and are physically located in either Niagara County, NY; Erie County, NY; or Wyoming County, NY. All decisions are final. Participation in the Contest constitutes the entrant’s full and unconditional agreement to these Official Rules. Winning a prize is contingent upon fulfilling all requirements as set forth herein.
2. Timing: The Contest consists of a one-time sweepstakes starting on December 5, 2022 and ending on December 9, 2022 at 11:59 AM EST, conducted and administered at the sole discretion of Ninja Graphics, Inc. (“Company”) The Company’s computer is the official time-keeping device for the Contest.
3. How to Enter: During the Contest Period, Entrant shall complete the online entry form at www.ninja-graphics.com/graphics/giveaway.
4. Prizes: Winners will receive one (1) customized Baggo Bag Toss game set. The specifics of the prize and the overlayed design shall be solely determined by the Company. No cash or other prize substitution permitted. The prize is non-transferable. Any and all prize related expenses shall be the sole responsibility of the winner, including picking up the awarded prize during our normal business hours at 101 Jamison Rd. Building A. Unit 1, Elma, NY 14059.
5. Limit: One (1) entry per person will be accepted during the Contest Period. Any attempt by an Entrant to obtain more than the stated number of entries by using multiple/different email social media accounts, or any other methods will void that Entrant's Contest entry and that Entrant may be disqualified. The Company is not responsible for late, incomplete or misdirected online entries, computer problems, internet service provider malfunctions, or error of any kind.
6. Contest: The Company’s decisions as to the administration and operation of the Contest and the selection of potential winners are final and binding in all matters related to the Contest. The Company will randomly select the Contest winners, from all eligible entries on or around 12:00 PM EST on December 9, 2022. (“Ninja Graphics Baggo Bag Toss Game Giveaway”).
7. Verification: All potential winners are subject to verification by the Company, whose decisions are final and binding in all matters related to the Contest. An Entrant is not a winner of any Prize, unless and until Entrant’s eligibility, and the potential contest winner, have been verified and Entrant has been notified that verification is complete. The Company will not accept screenshots or other evidence of winning in lieu of the verification process. Potential Prize winners will be announced in a subsequent social media post on the Company’s social media pages. Potential Prize winners may or may not also be contacted via Direct Message. The Prize Winners must claim the Prize within 24 hours of attempted notification or an alternate winner may be selected.
8. Odds of Winning: The odds of winning the Prize depends on the number of eligible entries received during the Contest Period.
9. Release: By participating in the Contest and/or by receiving any Prize, Entrant and/or Prize Winner agrees to release and hold harmless Ninja Marketing, Inc. and Others (as defined above) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest and/or receipt, use or misuse of any Prize.
10. Publicity: Except where prohibited by law, participation in the Contest constitutes Entrant’s consent to the Company’s, Others’, and its respective licensees’, successors’, and assigns’ use of the Entrant’s name, likeness, photograph, voice, statements, and/or hometown and state for promotional purposes in any media, worldwide and in perpetuity, without further payment or consideration, notification, review or approval.
11. Limitations of Liability Indemnification: The Company and Others are not responsible for any injury or damage, whether to persons or property, from participating in the Contest. If, for any reason, the Contest is not capable of running as planned, the Company reserves the right in its sole discretion to cancel, terminate, modify or suspend the Contest (or any portion thereof) and/or proceed with the Contest, including the selection of Prize Winner(s). Prizes are awarded “as is” with no warranty or guarantee, either expressed or implied by the Company or Others. As a condition of participating in the Contest, each Entrant agrees to release, defend, indemnify and forever hold harmless Ninja Graphics, Inc. and Others from and against any injuries, death, losses, costs, expenses, damages, claims, judgments, causes of action and any liability of any kind in connection with, resulting from or arising from the Contest, participation in the Contest, including without limitation, acceptance, receipt, delivery, possession, use, misuse, inability to use, defect or nonuse or loss of the Prize that may be awarded.
